Dispute Resolution

You and MTG mutually agree to the following dispute resolution process in the event of any controversy, claim, or dispute (“Dispute”) relating to or arising out of your use of the Services, other than disputes related to or involving our intellectual property or our licensed intellectual or proprietary rights:

  • The parties will first make a sincere effort to settle any disagreement through informal negotiation. When the party asserting the dispute sends a written notice to the other party outlining the specifics of the dispute, the informal negotiation period will start. If the parties are unable to come to an agreement within sixty (60) days of the date the notice of dispute was sent, either party may begin binding arbitration. By mutual written agreement, the parties may decide to extend the informal dispute resolution period.
  • You and MTG concur that binding arbitration before a single arbitrator chosen by both parties will have exclusive jurisdiction over the dispute if the parties are unable to settle it amicably. If the parties are unable to come to an agreement regarding the choice of an arbitrator, they shall each choose one arbitrator from the list of JAMS-qualified arbitrators, and then those two arbitrators shall choose the arbitrator for the particular dispute. JAMS will administer the arbitration in the New York, New York, area in accordance with its Comprehensive Arbitration Rules and Procedures. Notice of Right to Opt-Out of Sale and Sharing of Personal Information

Residents of California have the option to refuse the “sale” of their personal information. According to the CCPA, the term “sale” broadly refers to the sharing of personal information with third parties who are not serving as our service providers and who are not otherwise prohibited from using the information only on our behalf or in accordance with a relevant CCPA exception.

In certain situations, we might share some of your information with third parties in order to offer you opportunities, promotions, and offers that might be of interest to you. This might be regarded as a “sale” under the CCPA. Residents of California are also given the option under the CCPA to refuse the “sharing” of their personal data for “cross-context behavioral advertising.” The targeting of advertising to a consumer based on that consumer’s personal information obtained from that consumer’s activity across websites is described as this activity under the CCPA. To deliver more pertinent and individualized advertising to you about our Services and the services of our partners, we “share” information for these purposes.

California “Shine the Light” Disclosure

If a business shares “personal information” (as defined in California’s “Shine the Light” law, Civil Code 1798.83) with third parties for their direct marketing purposes (such as sending offers and information that may be of interest to you), California law requires that either a mechanism be provided by which consumers can obtain more information about such sharing over the previous calendar year or that a mechanism be provided by which consumers can opt out of such sharing. As previously mentioned, we offer an opt-out for this sharing.
